Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Radar 61 ("we", "us", "our"), operator of the Radar 61 platform accessible via radar61.com and associated applications.

By registering for an account, accessing the platform, or using any feature of Radar 61, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Disclaimer, each incorporated herein by reference.

These Terms apply to all users, including free trial users, paid subscribers, signal providers, and any other category of user accessing the platform.

Eligibility

To use Radar 61, you must:

• Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher
• Have the legal capacity to enter into binding contracts under applicable law
• Not be located in a jurisdiction where access to financial market data tools, trading platforms, or signal services is prohibited or requires regulatory licensing that Radar 61 does not hold
• Not be subject to any sanctions, export controls, or regulatory restrictions that would prohibit your use of the service

By using Radar 61, you represent and warrant that you meet all eligibility requirements. If you are using Radar 61 on behalf of a business entity, you also represent that you are authorised to bind that entity to these Terms.

You may not use a username that is the name of another person, a registered trade mark belonging to another party, or a name that is offensive, vulgar, or obscene.

Description of Service

Radar 61 is an AI-powered market intelligence and signal analysis platform. The platform provides, among other features:

• Automated technical pattern recognition across multiple asset classes and timeframes
• AI-assisted signal scoring and confidence analysis based on multi-methodology confluence
• Real-time and scheduled notifications, alerts, and event intelligence
• A modular workspace for organising market data, watchlists, and analysis tools
• Integration capabilities with third-party platforms including MT4, MT5, and TradingView
• Educational and contextual content related to trading methodologies
• Signal combination builder tools for advanced users and signal providers

Radar 61 is an informational and analytical tool. It does not execute trades, manage funds, provide regulated financial advice, or act as a broker, dealer, investment adviser, or financial institution of any kind.

Features, modules, and functionality may change at any time. We reserve the right to add, modify, or discontinue any part of the platform with or without notice, subject to any obligations under your active subscription.

Subscriptions and Payments

Subscription Plans

Radar 61 may offer tiered subscription plans, free trials, and promotional pricing. Specific plan details, features, and pricing are displayed on the platform at the time of purchase and are subject to change with reasonable notice.

Billing

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). By providing payment details, you authorise Radar 61, or its designated payment processor, to charge the applicable fees on each renewal date.

Refunds

Payments are generally non-refundable except where required by applicable consumer protection law. If you believe a charge was made in error, contact us at hello@radar61.com within 14 days of the charge date.

Cancellation

You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date. Radar 61 reserves the right to cancel or suspend subscriptions for breach of these Terms.

Taxes

All fees are exclusive of applicable taxes, levies, or duties. You are responsible for any taxes applicable to your subscription in your jurisdiction.

Permitted Use

Subject to these Terms, Radar 61 grants you a limited, non-exclusive, non-transferable, revocable licence to access and use Radar 61 for your personal or internal business trading analysis purposes.

Signal providers who are granted appropriate plan access may distribute signal outputs derived from Radar 61 to their own subscriber base, subject to the specific terms of their plan and any additional signal provider agreements in place.

Prohibited Conduct

You agree not to:

• Scrape, copy, reproduce, or redistribute platform data, signals, or content for any commercial purpose not expressly permitted by your subscription plan
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of Radar 61 or its underlying algorithms
• Share account credentials or allow unauthorised third parties to access your account
• Use the platform to transmit spam, malware, or any content that is unlawful, harmful, or fraudulent
• Attempt to circumvent, disable, or interfere with security features or access controls of the platform
• Use automated tools, bots, or scripts to access or interact with the platform in a manner not expressly permitted
• Represent that Radar 61 signals or scores constitute regulated financial advice when distributing or referencing them to others
• Use Radar 61 in any manner that violates applicable laws or regulations in your jurisdiction

Violation of these prohibitions may result in immediate suspension or termination of your account without refund.

Intellectual Property

All content, software, algorithms, scoring systems, data structures, visual design, trade marks, and proprietary methodologies on or within Radar 61 are the exclusive intellectual property of Radar 61 or its licensors. Nothing in these Terms grants you any ownership rights.

The "Radar 61" name, logo, and associated product identifiers are trade marks of Radar 61. You may not use them without prior written consent.

Any feedback, suggestions, or ideas you provide regarding Radar 61 may be used by Radar 61 without obligation or compensation to you.

Third-Party Integrations

Radar 61 connects with third-party platforms and data providers including, but not limited to, MT4, MT5, TradingView, economic calendar services, and market data feeds. These integrations are provided for convenience. Radar 61 does not own, control, or warrant the accuracy, availability, or reliability of any third-party service.

Our Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. We strongly advise you to read the terms and conditions and privacy policies of any third-party services you visit.

Your use of third-party services connected through Radar 61 is governed by the terms and privacy policies of those third parties. Radar 61 is not liable for any loss or disruption arising from third-party service failures, changes, or discontinuations.

No Financial Advice

Radar 61 is an informational and analytical tool. All signals, scores, pattern identifications, alerts, confidence ratings, and market analysis outputs generated by the platform are for informational and research purposes only.

Nothing on Radar 61 constitutes, or should be interpreted as, financial advice, investment advice, regulated trading recommendations, or an offer or solicitation to buy or sell any financial instrument. Please refer to our Disclaimer for full detail.

You are solely responsible for all trading decisions you make. Trading financial instruments involves significant risk of loss. You should seek independent professional advice before making any trading or investment decision.

Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Service will function uninterrupted, secure, or free of errors at any particular time.

To the maximum extent permitted by applicable law, Radar 61, its directors, employees, partners, and affiliates shall not be liable for:

• Any trading losses, missed opportunities, or financial damage resulting from use of or reliance on Radar 61 outputs
• Any indirect, incidental, consequential, special, or punitive damages, even if we have been advised of the possibility of such damages
• Loss of data, service interruptions, or errors in signal generation, pattern detection, or scoring
• Actions of third-party integrations or data providers

Where liability cannot be excluded by law, our total aggregate liability to you shall not exceed the total fees paid by you to Radar 61 in the 12 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Radar 61 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with: (a) your use of Radar 61 in breach of these Terms; (b) your violation of any applicable law or regulation; (c) any trading decision or financial loss resulting from your use of the platform; or (d) any content or signals you distribute to third parties based on Radar 61 outputs.

Termination

You may terminate your account at any time by contacting us at hello@radar61.com or through your account settings.

Radar 61 may suspend or terminate your access at any time, with or without cause, with or without notice. Grounds for termination include breach of these Terms, non-payment, fraudulent activity, or actions that harm the platform or other users. Upon termination, your right to use the Service will immediately cease.

Sections 7, 9, 10, 11, and 14 shall survive termination.

Modifications to These Terms

Radar 61 reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you via email or prominent in-app notice at least 14 days before the changes take effect, where reasonably practicable.

Your continued use of Radar 61 after the effective date of any changes constitutes your acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of Radar 61 shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of the State of Wyoming, USA, unless mandatory local consumer protection laws provide otherwise.
